Strict Variance Standard Met

4/10/2010

New Garden Township has issued a building permit to firm client Liberty Towers for the construction of a new 150-foot monopole tower.  The building permit was issued after Lemanowicz LLP attorneys Richard J. Lemanowicz and Crystal J. Fisher obtained a variance from the Township's Zoning Hearing Board.  Mr. Lemanowicz and Ms. Fisher invoked Pennsylvania common law standards to persuade the Board that the underlying property's unusual size and shape precluded alternative uses.  Through their aggressive legal work, Mr. Lemanowicz and Ms. Fisher enabled Liberty to meet Pennsylvania's traditionally stringent variance standard, which will allow area residents to enjoy improved wireless service.
